Violations & Complaints
An important part of what makes the Village of Marcellus a great place to live is the regular enforcement of quality of life regulations. The code enforcement office investiagtes all complaints it receives.
Complaints should be submitted to the village clerk in writing when practicable. If you have any evidence (e.g., photograph, newspaper ad, business card, etc.) that might help document the violation, please enclose it with the completed complaint form.
Department staff will review your complaint and the applicable laws or ordinances. If additional information is required, we will contact you to discuss the matter. If it is determined that the alleged activity could be in violation of the Village Code or other law, a violation case is opened to investigate the matter. At this time our staff will send a Courtesy Notice informing the alleged violator of the complaint, and request that they rectify the issue and contact us. Generally violations are rectified following receipt of the Courtesy Notice and no further action is needed.
Some common violations we see include:
Litter: Storing or placing litter in outdoor areas on the property. Litter includes but is not limited to: trash, garbage, auto parts, scrap metal, scrap wood, construction debris, wood pallets and abandoned automobiles.
Unlicensed/dismantled vehicles: Storing or parking any unlicensed vehicle outdoors for more than 30 days or any dismantled vehicles outdoors.
Open burning: Open burning is prohibited within the village. Small outdoor fireplaces are allowed so long as a spark arresting screen is in use and the smoke does not bother neighbors.
Construction without a permit: Building permits are required for all structures and building projects including sheds, fences, wood and pellet stoves and swimming pools over 24 inches deep. Building permits are also required for electrical and plumbing work and when replacing or reconstructing any structure.
Storable Swimming Pools: Any pool over 24-inches in depth requires a building permit and pool alarm. In addition any pool with side walls that are less than 48" in height or not sturdy requires a fence.

Signs: All "permanent" business signs require permits and their placement and size is limited by the zoning ordinance. Non-profit, political, garage sale and other temporary signs also require a permit. Such signs must not be placed where they may create a hazard and may not be
affixed to any telephone pole or other public property and must not be erected for more than 30 days.
