Village Office
In addition to having a mayor and a board of trustees, every village in New York state is required to have a Treasurer and a Clerk.
The Village Clerk is appointed by the mayor, subject to approval of the Board of Trustees. The clerk at the present time is Charnley Abbott, appointed to that position in July of 2018.
Duties as Clerk
Each village must have a officer to coordinate the various village functions and to perform administrative tasks not assigned to other village officials. Subject to the direction and control of the Mayor, the Clerk in the Village of Marcellus has a variety of statutory duties.

• Act as clerk of the Board of Trustees and of each board of village officers and keep
a record of each board's proceedings • Keep a record of all Village Resolutions, ordinances and local laws • Have custody of the corporate seal, books, records and papers of the Village and all the official reports and communications of the Board of Trustees • Produce official records on demand of any person during office hours set by the Board of Trustees and certify proper copies of those records • Keep an indexed record of all written notices received reporting a defective, unsafe, dangerous, or obstructive condition in the village streets and sidewalks and bring each notice to the attention of the Board of Trustees at the next board meeting • Perform other duties not inconsistent with the office as determined by resolution of the Board of Trustees • Prepare and issue all utility billings |
Resolutions, Laws, Hearings
In addition to these responsibilities, the Clerk has a variety of duties, too numerous to list, assigned by specific state laws. Generally the Clerk is responsible for the timely filing, publication, and posting of notices relating to resolutions, local laws, public hearings and referenda. He or she must maintain a sign board on which public notices are displayed. The Clerk notifies the proper state and municipal officials, as required by law, of certain village business, such as a change in the village name or boundaries. The Clerks office usually is designated to receive formal notices for filing, such as certificates by the state or an affidavit by a person with a claim or account owed by the village. Records, Notices, Elections The clerk's office also serves as the central repository of records of interest to the village and its residents. Agency and department reports are filed with the clerk, and copies must be kept in the clerk's office. Petitions requesting referenda must be filed in the clerk's office, and the clerk has certain duties regarding the posting of notices of referenda and informing the public of dates, times, and polling places. Maps of the village showing streets, corporate boundaries, local improvements, sewer, drainage and water systems are filed in the clerk's office. The Clerk is also responsible for filing petitions for candidates for village offices, oaths and affidavits of eligibility from office-holders, election notices, election returns, zoning maps and many other records. The Clerk's office is equipped and staffed to provide the general public, both resident and nonresident, with information on many subjects related to local government, services available, village legislation, and state laws enforced by the village. In addition, the Clerk is expected to communicate information from the Village Board of Trustees to the departments of village government. The Clerk must necessarily be familiar with all village departmental operations and officers. |

Treasurer
The Treasurer in the Village of Marcellus is the chief fiscal officer of the village. The present Treasurer, Nino Provvidenti, was appointed in 2010. The treasurer must:
Have custody of all village funds
• Prepare and issue all tax billings • Keep accounts of all receipts and expenditures • Audit the village finances annually • Pay out money owed by the village when the debt is properly documented and approved • Prepare an annual budget in coordination with village board • Be responsible for the management and administration of the budget and for generally ensuring adequate funding of village functions • Project expenditures and revenues for the fiscal year • Serve as a guardian of village finances, trying to improve the efficiency and economy of village operations • Supervise the bidding procedure and award the contract to the lowest bidder • Perform other duties consistent with the office and authorized by the board of trustees • Collect taxes and assessments of the village Conclusion The offices of Village Clerk and Treasurer are funded by local taxes and fees and other revenues collected by the Clerk and Treasurer. In the Village of Marcellus, the village office staff consists of two full-time individuals, the Clerk and Treasurer. The Mayor appoints individuals to these positions, subject to the approval of the Board of Trustees. |

Village Attorney
Village Attorney
The Village of Marcellus employs a lawyer to serve as Village Attorney and provide legal services for the village. This is a part time position and the duties of the Village Attorney are not specifically set forth by statute. The Village Attorney, however, works closely with village departments, officers and bodies, especially the Board of Trustees. The specific services which the village attorney performs are assigned by the Board and include: • Preparing legal notices, contracts and opinions • Acting as local bonding counsel • Providing services in connection with the acquisition of easements and title to real property, including negotiations with property owners • Preparing local laws, ordinances, and resolutions • Representing the village in litigation in eminent domain, assessment, and other cases, including appeals • Consulting with village officials, employees, and members of the public regarding matters involving the village • Attending meetings of the zoning board of appeals, planning board and town board and preparing legal notices and opinions for them • Reviewing insurance coverage • Giving legal advice in contract negotiations Further duties Although criminal prosecutions generally are handled by the Onondaga County District attorney, the Village of Marcellus Attorney also may prosecute violators of specific village ordinances or any person accused of committing an offense, infraction, or criminal act within the village. |
